Terms and Conditions for KreisViereck UG's Padel League for Companies
1 Introduction and Acceptance
(1) The following Terms and Conditions ("Terms") are applicable to all padel events ("Events") organized by KreisViereck UG, Lohmühlenstraße 65 c/o Factory Works 12435 Berlin, Germany ("we", "us", "our"). These Terms set forth the legal obligations and rights between us and the participants ("you").
The designated team captain, chosen by the participating company, acts as the primary liaison with us. By registering for an event, the team captain agrees to these Terms on behalf of their team and company.
The term participant will be used to describe any person that attends one or more events and/or has indicated to be part of a team in the digital platform used to organize the Padel league.
(2) We reserve the right to amend these Terms as needed. The version valid at your registration time will apply to our contractual relationship.
(3) For any communication with us, participants should direct their queries to KreisViereck UG at the specified address.
2 Eligibility and Conduct
(1) All participants must be at least 16 years old. Those under 18 require a guardian’s consent to participate.
(2) It is your responsibility to stay informed about any event updates through our website or other digital platform.
(3) Formation of teams with a minimum specified number (two at least) of participants is required.
(4) We will attempt to announce necessary organizational details and safety measures at least 24 hours before the event on our website and/or other digital platform. However, we do not take responsibility in case we are unable to adhere to this schedule.
(5) Compliance with all directives from us and our designated personnel is mandatory. Failure to comply may result in expulsion from the event.
3 Registration, Fees, and Cancellation
(1) Registration must be completed on our website. The team captain represents and is accountable for all team members and their adherence to these Terms.
(2) All payments will occur as a subscription via the online payment provider "Stripe". Repeatedly failed payments may lead to exclusion from the league and thereby any further events.
(3) Event participation and registration are specific to the registrant and not transferable.
(4) It may be required for participants to register in a digital application that is used to organize the league. Personal data collected by this platform may include, but is not limited to: name, gender, birthdate/age, profile picture, and (optionally) location.
4 Liability Waiver
(1) Events may be cancelled due to weather, safety concerns, or other unforeseeable reasons. The minimum amount of ten events per season will be kept. In case it is necessary for an event to be rescheduled, we will attempt to find a time and date that allows most participants to attend, but we are not liable in case participants are unable to join at the rescheduled time, except in cases of willful misconduct or gross negligence.
(2) We limit our liability for loss or damage to cases of intentional or grossly negligent acts.
(3) Participants engage in events at their own risk, with us bearing no liability for health-related issues arising from participation.
(4) We will organize at least ten events per season (3 months). We are not liable in case participants are unable to join one or more of these events.
5 Privacy and Data Use
(1) We collect personal information for event organization, payment processing, and as legally required. By registering, you consent to this collection and use on behalf of yourself and your team.
(2) We may use photos and videos from the events for promotional purposes without compensation. Your registration signifies consent to this use.
(3) Personal information may be shared with third-party services for event-related purposes, with your registration indicating agreement to such sharing.
6 Compliance and Disputes
(1) We will communicate the specific rules of the tournament prior to its commencement. It is your responsibility to acquaint yourself with these rules.
7 Miscellaneous
(1) Prizes must be accepted as awarded and are not redeemable for cash. Exchanges or transfers of prizes are not permitted.
(2) If any part of these Terms is found to be invalid, the remainder will still apply. We will endeavor to replace any invalid provisions with valid ones that achieve the intended legal result.
(3) Disputes arising under these Terms will be resolved in the jurisdiction of Berlin unless otherwise required by law.
(4) These Terms are governed by German law, except where superseded by international statutory obligations.
8 Cancellation
(1) In case the league is cancelled by us, regardless of the reason, you will receive a partial refund in case less than 10 events have been organized.
(2) For each event organized, 10% less of the price paid for the season will be refunded. If 10 events have been organized, you will not be eligible for a refund.
